Probate and Administration of Estates

It may be necessary to probate or administer an estate, and its assets, upon someone's death.  Probate involves the "proving" of the validity and proper execution of a will.  An administration proceeding occurs when someone dies with assets in their name and without a will. 

Probate or administration proceedings occur in the Surrogate's Court of the County of the decedent's domicile at the time of death.  Either proceeding involves a rather detailed process and filings in the Surrogate's Court.  This process is geared to insure that a decedent's assets pass properly according to his or her will and the law.
